Terms of Use - ZipZest
1. Purpose and Scope
These Terms of Use (ToU) govern the use of the ZipZest platform, accessible at zipzest.ch (hereinafter "the Service"), offered by TheDesignClinic (hereinafter "we" or "ZipZest"). The Service is intended for Swiss restaurateurs (hereinafter "the User" or "you") for managing their customers, dishes, restaurants, and online payments.
2. Acceptance of the ToU
Use of the Service implies full acceptance of these ToU. If you do not accept these terms, please do not use the Service.
3. Description of the Service
ZipZest is a web application that allows Swiss restaurateurs to manage their online activities, including:
- Customer management
- Dish and menu management
- Restaurant information management
- Online payment management (via Stripe integration)
- Cash and Twint payment management
4. Access to the Service
4.1 The Service is accessible only after subscribing to a paid subscription via our payment provider Stripe.
4.2 The User benefits from a free one-month trial, followed by a monthly or annual subscription.
4.3 Subscription fees are non-refundable.
5. User Obligations
The User agrees to:
- Provide accurate and up-to-date information
- Use the Service in compliance with applicable laws
- Not attempt to disrupt or damage the Service
- Protect their login credentials
6. Liability
6.1 ZipZest disclaims all liability for any malfunction, bug, or any other problem related to the use of the Service.
6.2 The User is solely responsible for their use of the Service and the consequences thereof.
7. Intellectual Property
All intellectual property rights relating to the Service are the exclusive property of ZipZest.
8. Personal Data Protection
8.1 ZipZest is committed to protecting Users' personal data in accordance with current Swiss legislation.
8.2 ZipZest uses Matomo for analyzing Service usage data.

9. Modification and Termination
9.1 ZipZest reserves the right to modify these ToU at any time.
9.2 ZipZest may terminate or suspend access to the Service in case of non-compliance with the ToU.
10. Applicable Law and Jurisdiction
These ToU are governed by Swiss law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of Swiss courts.
